  • In the event that a student is referred for placement by the ARD/IEP Committee at TSD, HISD is responsible for assuring that a free appropriate public education (FAPE) is provided to the student at TSD. If HISD and representatives of TSD disagree to a recommendation that the student be evaluated for initial placement or continue to be placed at TSD, both HISD and TSD, as applicable, may seek resolution through the mediation procedures adopted by the Texas Education Agency or through any due process hearing to which HISD or TSD are entitled under the IDEA.

    When an ARD/IEP Committee places the student at TSD, HISD will comply with the following requirements:

    • For each student, HISD will list the services in the student's individualized education program (IEP) which TSD can appropriately provide.
    • The district may make an on-site visit to verify that TSD can and will offer the services listed in the individual student's IEP and to ensure that the school offers an appropriate educational program for the student.
    • For each student, HISD will include in the student's IEP the criteria and estimated time lines for returning the student to HISD.


    TSD will provide services in accordance with TEC, §30.051, to any eligible student with a disability for whom TSD is an appropriate placement provided that the student has been referred for admission by: (a) the student's parent or legal guardian, (b) a person with legal authority to act in place of the parent or legal guardian, or (c) the student, if the student is age 18 or older.

    TSD will provide services at any time during the school year if the referring person chooses TSD as the appropriate placement for the student rather than placement in the student's resident school district or regional program determined by the ARD/IEP Committee.

    TSD will be responsible for assuring that a FAPE is provided to the student at TSD, in accordance with IDEA, state statutes, and rules of the SBOE and the commissioner of education.

    For each student placed in a residential setting by the student's ARD/IEP committee, including those students placed in TSD, HISD will be responsible for transportation at the beginning and end of the term and for regularly scheduled school holidays, including weekends, when students are expected to leave the residential campus. HISD is not responsible for transportation costs for students placed in residential settings by their parents. When it is necessary for the safety of the student, as determined by the ARD/IEP committee, for an adult designated by the ARD/IEP committee to accompany the student, round-trip transportation for that adult shall also be provided. HISD and TSD shall coordinate to ensure that students are transported safely, including the periods of departure and arrival.
